Kindly take note that our website and social media platforms may contain links to third-party websites or services that are not owned or controlled by us. We also occasionally like, share and repost content from other providers and creators on our various platforms.

The Travelling Wakili has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites, social media platforms, creators or service providers and will not be held responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or social-media platforms.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites, platforms or services that you visit.

  1. Booking and Payment
    1. 1.1

      To secure a booking, clients must pay a non-refundable deposit, which will be deducted from the total trip cost.

    2. 1.2

      Full payment is due 13 days prior to departure for local trips and 29 days prior to departure for International trips. Failure to pay by the due date may result in cancellation of the booking and forfeiture of the deposit.

    3. 1.3

      Payment can be made by credit card, bank transfer or M-pesa directly to our card holder in Kenya, Pesapal or through our booking platform - Mos Mos.

    4. 1.4

      In the event of the above not being accessible, other methods may be used once agreed upon.

  2. Cancellation and Refunds
    1. 2.1

      Clients may cancel their booking at any time, subject to the following cancellation fees:

      1. 2.1.1

        For Local Trips:

        • 60 - 30 days prior to departure: 30% of the total trip cost
        • 29 - 14 days prior to departure: 50% of the total trip cost
        • Less than 13 days prior to departure: No refund
      1. 2.1.2

        For International Trips:

        • 80 - 60 days or more prior to departure: 30% of the total trip cost
        • 59 - 30 days prior to departure: 50% of the total trip cost
        • Less than 29 days prior to departure: No refund
    2. 2.2

      Refunds, if applicable, will be processed within 7 days of cancellation for local trips and within 30 days for International trips.

    3. 2.3

      The Travelling Wakili reserves the right to cancel a trip due to unforeseen circumstances such as, but not limited to extreme weather changes, illness, death, insecurity, political concerns and less than 50% enrollment.

    4. 2.4

      In cases of insufficient enrollment, clients will be notified at least 7 days to the start of the trip and for other cases, before the start of the trip through a call. Clients will receive a full refund of the trip cost or the option to reschedule.

    5. 2.4

      The Travelling Wakili is not liable for any trip extensions that the traveller chooses to make - this extension can be before or after the trip.

  3. Changes to Itinerary
    1. 3.1

      The Travelling Wakili reserves the right to modify the itinerary or accommodations if necessary due to unforeseen circumstances.

    1. 3.2

      Clients will be notified of any changes as soon as possible. If the changes significantly alter the trip experience, clients may choose to accept the changes or cancel their booking for a full refund.

  4. Travel Insurance
    1. 4.1

      It is strongly recommended that clients purchase travel insurance to cover unexpected events, such as trip cancellation, medical emergencies or lost items.

    2. 4.2

      The Travelling Wakili is not responsible for any costs incurred due to lack of travel insurance.

  5. Health and Safety
    1. 5.1

      Clients are responsible for ensuring that they are fit to travel and are up to date with any required vaccinations.

    2. 5.2

      The Travelling Wakili reserves the right to refuse service to clients who pose a safety risk to themselves or others.

    3. 5.3

      Clients who identify as part of a sexual minority understand the risks associated with being queer in Kenya and the rest of the world. The Travelling Wakili undertakes to provide safety for queer clients’ in as far as is reasonably possible.

  6. Health and Safety
    1. 6.1

      The Travelling Wakili is not liable for any loss, injury, or damage to personal property during the trip, unless caused by negligence on the part of the Travelling Wakili.

    2. 6.2

      Clients participate in activities at their own risk and are responsible for their own safety.

  7. Privacy Policy
    1. 7.1

      The Travelling Wakili collects personal information for the purpose of booking and providing travel services.

    2. 7.2

      Clients consent to collection of data on age, sexuality, gender and location for purposes of record-keeping. This information may be shared to a third party without being identifiable to a specific traveller for purposes of research, education and promoting Travelling Wakili growth.

  8. Governing Law and Disputes
    1. 8.1

      These terms and conditions are governed by the Laws of Kenya.

    2. 8.2

      In the event of a dispute, the parties involved shall first attempt to amicably resolve it by discussing it amongst themselves.

    3. 8.3

      Should that fail, the parties shall consent to mediation presided over by a single mediator, appointed through mutual agreement by the parties. The Mediator’s fees shall be borne equally by both parties. The mediation process can be conducted in person or by way of electronic conference.

    4. 8.4

      Should mediation fail, parties shall be subject to The Laws of Kenya and each party is free to file a case in Nairobi, Lamu or any other appropriate jurisdiction within Kenya.

  9. Relationships
    1. 9.1

      One of the core pillars of the Travelling Wakili is building community, friendships and relationships not just with our clients but promoting the same amongst those on the trips. The Travelling Wakili does not accept any liability in the form of loss, harm or deceit that arises from any relationships formed before, during or after our trips.

    2. 9.2

      Clients are encouraged to exercise discernment and due diligence when interacting with anyone on the trip.

    3. 9.3

      Clients are asked to be respectful of everyone. The Travelling Wakili does not condone sexism, classism, homophobia, tribalism, racism, islamophobia or transphobia on any of our trips. Sexual harassment, assault or abuse of any kind will also not be tolerated.

    4. 9.4

      In the event of any of the above or any other issue, Clients are requested to notify the host or guide in charge of the same as soon as possible.

    5. 9.5

      In the event that the misconduct is caused by the host, guide or any other Travelling Wakili agent, the Travelling Wakili shall handle the same in accordance with its internal policies and regulations in place to mitigate such issues.

  10. Photography & Videography
    1. 10.1

      The Travelling Wakili and its agents may take photographs and or video during the trip for use in promotional materials including but not limited to online and offline advertising, social media, press releases and other publications.

    2. 10.2

      By consenting to photography in the google form, you grant The Travelling Wakili and its agents’ the right to use your image and likeness for such purposes. If you do not wish to be photographed or recorded, kindly indicate in the form.

    3. 10.3

      Please be aware that The Travelling Wakili is not responsible for photographs or videos taken by other travellers or service providers.

  11. Feedback
    1. 11.1

      The Travelling Wakili is transparent about its principles and welcomes feedback.

    2. 11.2

      We understand that group travel is not ideal for everyone and ask that if you are unhappy about something, kindly let the host or guide know as soon as you can to allow for a better experience. With that being said, we collect data prior to the trip so as to adequately cater to each traveller and the group as a whole. We will not be held liable for omissions made on dietary needs, accessibility concerns and or any other accommodations already provided for in the google form.

    3. 11.3

      We collect anonymous feedback after each trip and are committed to continuous growth and improvement. If you are comfortable letting us know your identity, do not hesitate to include your name and where possible, what we can improve on.

  12. Acceptance of Terms
    1. 12.1

      By booking a trip with The Travelling Wakili, clients agree to these terms and conditions.
